2. Project Initiation
A project is considered active once the required initial payment or approved payment arrangement has been received. Delays in providing required content, materials, access, or approvals may affect the project timeline. RMJ Web Designs will not be responsible for delays caused by the client’s failure to provide required items or approvals within the agreed timeframe.
3. Payment Terms
Clients are required to make the full payment of the project cost before any work begins.
Payments can be made via credit card, bank transfer, or other approved methods. Failure to make payment may result in delays or suspension of services.
4. Refund Policy
We do not offer refunds after 30 days from the purchase date if no required materials (content, design preferences, etc.) have been provided by the client. 5. Revisions and Changes
We strive to ensure client satisfaction by offering revisions based on agreed specifications. However, changes beyond the original scope of work or after final approval will be subject to additional fees. A detailed outline of revisions will be provided during the project’s approval process.
6. Intellectual Property
Upon full payment, ownership of the final website design, including content, graphics, and other assets, will be transferred to the client. RMJ Web Designs retains the right to display work in portfolios or marketing materials unless explicitly prohibited in writing.
7. Hosting and Maintenance
RMJ Web Designs offers hosting and support services through RMJ Web Hosting and may also work with client-selected third-party hosting providers. Hosting, maintenance, and ongoing support are separate services unless they are specifically included in a package, proposal, invoice, or written agreement. Clients using an external hosting provider remain subject to that provider’s own terms, policies, availability, and service limitations.
8. Client Responsibilities
The client is responsible for providing all content, images, branding guidelines, and any other material required for the project. Failure to do so within the specified timeframe may delay the project, and additional fees may apply for extended delays.
9. Third-Party Services
RMJ Web Designs may integrate third-party services or software into the website (such as plugins, analytics tools, or payment gateways). We are not liable for issues arising from these third-party services, including security risks, functionality failures, or data breaches.
10. Limitation of Liability
RMJ Web Designs will not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services, website errors, or delays caused by the client’s actions or third-party providers.
11. Termination of Services
RMJ Web Designs reserves the right to terminate services if a client violates any of the terms outlined herein, fails to provide necessary materials, or exhibits inappropriate conduct toward our team. Clients will be given notice and a chance to remedy the situation before termination.
12. Governing Law
These terms and conditions are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under this agreement shall be resolved through negotiation or mediation before seeking formal legal action.
13. Changes to Terms
RMJ Web Designs reserves the right to modify these Terms & Conditions at any time. Changes will be communicated via our website, and continued use of our services will constitute acceptance of the updated terms.
